Dive Brief:
- Whole Foods has been sued over its alleged use of non-GMO Project labels on Almond Breeze almond milk products while that company was still undergoing the Project's certification process.
- It's the timing of the labeling process, rather than the contents of the product, that is the center of the dispute. The lawsuit does not claim that Almond Breeze products contain GMO ingredients.
- Blue Diamond, the almond co-op that owns Almond Breeze, was not named in the suit.
Dive Insight:
Our limited, non-attorney knowledge of the law has us wondering just what the harm is to a consumer in labeling something as certified by the non-GMO Project a bit prematurely. Surely the Project would have grounds to sue, but it apparently does not. This is a class-action lawsuit on behalf of consumers.
